The 'Battle of Angamos' and National Holiday

First, you should know that on October 8, we commemorate the 'Battle of Angamos', a naval confrontation of the Pacific War in which our national hero, Miguel Grau Seminario, also known as the 'Knight of the Seas', died. Therefore, the Peruvian Government declared it a national holiday.

Is October 9 a Non-Working Holiday?

Through Supreme Decree No. 151-2022-PCM, it was established that this October 9th be declared as a non-working day for the public sector. However, the private sector can also benefit from it by prior agreement between the employer and its employees.

On the other hand, it is worth noting that the hours not worked on this Monday, October 9th, must be made up within a maximum period of 10 subsequent days.

Will I Be Paid Triple if I Work on Monday, October 9th?

The answer is NO. If you work on a non-working day, you will receive your regular daily remuneration in your sector. However, if you work on the national holiday of October 8th, you will receive extra payment.

Both the public and private sectors have the right to rest on October 8th and be remunerated normally. However, if in case you work at your workplace or remotely, two scenarios arise:

  • The employer grants a day off in compensation for the worked day.
  • If no compensation is given, the worker must receive three remunerations: one for the holiday, another for the work performed, and a 100% surcharge.

What are the Differences between Holidays and Non-Working Days?

On holidays, the worker must rest and receive their usual remuneration. But if they work, they must receive the corresponding surcharge payment or hours equivalent to rest.

On non-working days, the employee does not work but must make up the hours within the specified period. If they work, they will receive their usual remuneration without the surcharge.
