Who will be able to rest on Friday, October 13th and Monday, October 16th?
According to the calendar of non-working holidays in Argentina, Monday, October 16th is a holiday for public sector workers, so private sector workers who work on this day will be paid double.
The non-working day on October 12th for the Day of Cultural Diversity is transferable and, since this year it fell on a Thursday, it must be moved to Monday, October 16th, as stated in Law No. 27,399.
Why is October 13th and October 16th a holiday?
In the case of Friday, October 13th, it is a holiday for tourist purposes. This means that it is a day that the Government designates to ensure the rest of the citizens and promote tourism.
The Executive Power can establish up to three of these non-working days per year. In addition, they have the same characteristics as a national holiday. This means that they must be paid in the same way as non-working days.
Therefore, both days are paid as if they were a national holiday. "The days that are holidays, by application of the preceding articles, will enjoy, in terms of remuneration, the same rights established by current legislation regarding national holidays," says article 8 of the aforementioned regulation.
How will the October 13th and October 16th holidays be paid in Argentina?
Law No. 20,744 on Labour Contracts establishes the difference between national holidays and non-working days. In its article 165, it explains that they will be established in the legal regime that regulates them.
In this case, it refers to Law No. 27,399 on "Establishment of holidays and long weekends". Thus, the regulation in its clause 166 states that on national holidays, the legal rules regarding Sunday rest apply, while in clause 167 it explains that working days are optional for the employer, but if they decide to work, they will receive their regular salary.
