The Instruction Court number 18 of Barcelona has agreed the inadmissibility of the complaint filed by Baloncesto Fuenlabrada against the Association of Clubs (ACB) and its President, Francisco Roca, for the crime of document forgery as it is understood that there was no criminal offense.
Fuenlabrada filed a complaint considering that the organization favored the promotion to the first category of Ourense without meeting the requirements to do so. In this sense, the Madrid club considered themselves harmed. After checking the documentation provided, the judge has decided to dismiss the complaint considering that "from the description in the complaint and the documentation provided (by the club) it is not indicated which document is false," as explained in the resolution.
It is also specified that "the channels to challenge the promotion of CB Ourense must strictly be sports and administrative, with no criminal relevance to the described events."
Fuenlabrada appeals
Fuenlabrada, on the other hand, has announced that today it has appealed the non-admission of its complaint and has provided more documentation obtained in recent weeks, sources from the club informed EFE.
The Madrid club appealed the magistrate's decision on Friday, submitting more documentation that they have obtained during the past few weeks when the judicial process was already underway.
