The Fourteenth Specialized Civil Court with Commercial Subspecialty of the Superior Court of Justice of Lima resolved to admit for processing the lawsuit regarding the execution of an arbitral award filed by Universitario de Deportes against Gremco. RPP Noticias obtained the document exclusively.
The ruling orders that, at least, approximately 25 million soles (7 million dollars) be deducted from the debt that the club has with the company. In addition, this judicial decision would require the recalculating of the 'U's debt with Gremco, which originated from the arbitral award of 2000 for the construction of the Monumental Stadium and which Indecopi recognized for an amount close to 27 million dollars, plus the corresponding interest, which is a similar figure.
According to this judicial decision, whose file N° 15157-2016-0-1817-JR-CO-14 was initiated by the previous administration of Universitario, Solución y Desarrollo Empresarial S.A.C., with Raúl and Humberto Leguía as its visible faces, Universitario, through its current administration headed by Carlos Moreno, should continue with the corresponding judicial process, safeguarding the club's interests.
Likewise, Carlos Moreno's company, Consultoría de Finanzas Corporativas E.I.R.L., must propose specialized experts to update the debt with Gremco.
As it is known, the creditors' committee of Universitario, headed by José Gamarra, representative of Gremco, summoned all creditors for February 20 and 23 to approve the economic restructuring plan that will allow the payment of the approximately 370 million soles that Universitario owes.
