Andrea Sotomayor - Sports Secretary - and Andrés Tobón - intervener of the Guayas Sports Federation - refuted the allegation of alleged embezzlement in the contracting of the project to rebuild the track of the Alberto Spencer Model Stadium, made by Pedro Merchán, affiliated with Roberto Gilbert, opponent of Roberto Ibáñez's presidency of the FDG.
According to both officials, the complaint clears the Secretariat and FDG of any suspicion of a crime. "It is non-existent because embezzlement is a crime of action, misuse or misappropriation of public funds, something that has not happened. There is no figure of embezzlement by omission. It is never indicated which standard has not been observed," say Sotomayor and Tobón.

According to the Sports Secretary, "this complaint is another invention of lawyer Merchán to damage me. He keeps filing lawsuits and complaints against me and the Secretariat everywhere. I reserve the right to take legal action against anyone who intends to continue tarnishing my reputation and that of the other people who make up the Secretariat."
Regarding the contracting and execution processes of the project, the two public officials clarify that it is not the responsibility of the Sports Secretary but of CEAR EP. Sotomayor adds that the entity she heads is not involved in public procurement processes.
About the complaint that the company Consorcio Construcciones GYE was created on November 21 and when it won the bidding process it had no legal existence and joined Viptranscorp S.A. to be awarded the project, it is indicated that "the Organic Law of the National System of Public Procurement does not prohibit the presentation of a consortium with a commitment to future incorporation, as was the case."
According to Merchán, the company Viptranscorp S.A. is not dedicated to construction but to import and export of electrical supplies and appliances; "but in the SRI registry it is stated that it is dedicated to construction activities. This information contradicts what the complainant said," Sotomayor adds.
